So if someone groped you and you reflexivly hit or pushed them, you'd possibly be arrested for assault and nothing would happen to them?
OK, I had to update my earlier posting, as I have now read the specifics of this case.
It was actually taken from a publication of the Bavarian police after the "Oktoberfest".
They wrote - verbatim - (I translate from German) in their published "Wiesn-Report"
Bavarian Police said:
"A grip under his acquaintance's shirt - intended to be good fun - ended extremely painful for a 20-year old man from Deggendorf. The 'owner of the skirt' turned around including her Beer stein and the drinking vessel landed on the head of the cheeky fellow. "
Munich Police published this story as a funny anecdote of the "Wiesn".
As if it were perfectly normal to grab under a woman's skirt.
Never mind that the 20-year-old has acted wrongly. On the contrary:
"Of course, this constituted an offense of grievous bodily harm"
it said - but this was not referring to the groper, but to his young American acquaintance .
Only after payment of a "four-figure euro sum" the American woman was allowed to leave the meadow police station again.
Only now, 4 months after the fact, and after this downplaying of sexual violence by the Munich Police was widely shared in newspapers, did they change the wording of this incident....
I have heard that socialist lawmakers now want to close loopholes in the sexual assault laws, and that others want to make groping an offence if it happens in an "organized" manner (and likely if it is perpetrated not by upright Germans, but by dastardly foreigners), which seems to be a step in the right direction .... but IMO ONLY if they also make "normal" groping, by a single person against another single person an offence. This has been, in the past, if I remember correctly not in the favour of conservative politicians, who tend to be apologetic of such things
(unless dastardly foreigners are the perpetrators, of course)
Also ... what happens if a straight male should grope another male - is that an offence? what if one of the two (or both) are homosexual? Ah, the new age brings lots of problems here....
